1. Acceptance
By using Diamond's services, you agree to be bound by these Terms. If you are using the service on behalf of a company or organization, you represent that you have the authority to accept these Terms on their behalf. Continued use of the service after any modification constitutes acceptance of the updated Terms.
2. Service Description
Diamond provides web hosting services including shared hosting, VPS, dedicated servers, domain registration, SSL certificates, and email hosting. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable prior notice to users.
3. Acceptable Use
You may not use our services to publish unlawful content or content that infringes intellectual property rights, send unsolicited commercial communications (spam), conduct DDoS or other cyberattacks, host malware, ransomware or piracy tools, facilitate illegal transactions, or engage in any activity that places an unreasonable burden on our infrastructure or harms other users.
4. Accounts & Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any suspected unauthorized access or security breach. Diamond is not liable for losses arising from unauthorized account use where the breach was not caused by our negligence.
5. Payment & Billing
Payments are processed by Paddle.com Market Ltd. as our authorized Merchant of Record. All prices are listed upfront and may be subject to applicable sales taxes based on your location. Paddle is responsible for collecting and remitting taxes on our behalf. In the event of non-payment, we reserve the right to suspend service after a 7-day written notice period.
6. Uptime & Service Level
Diamond targets 99.9% monthly uptime for hosting services. Scheduled maintenance windows will be announced at least 48 hours in advance where possible. We are not responsible for outages caused by third-party networks, force majeure events, or actions outside our reasonable control.
7. Data & Backups
While Diamond performs regular backups as part of its infrastructure management, you are solely responsible for maintaining your own independent backups of your data. Diamond's backups are provided as a convenience and are not guaranteed. We strongly recommend maintaining your own offsite backups at all times.
8. Termination
You may cancel your subscription at any time through your control panel. We may terminate service immediately and without prior notice in the event of a material breach of these Terms, including but not limited to illegal activity or abuse of infrastructure. Upon termination, you must export your data within 30 days after which it will be permanently deleted.
9. Limitation of Liability
Diamond shall not be liable for indirect, incidental, special, or consequential damages arising out of your use of the service. Our total liability to you shall not exceed the total fees paid by you in the 12-month period immediately preceding the claim. This limitation applies to the fullest extent permitted by applicable law.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable international commercial law and the laws of the jurisdiction in which Diamond is registered. Any disputes shall first be attempted to be resolved through good-faith negotiation before resorting to formal legal proceedings.
11. Modifications
We reserve the right to update these Terms at any time. Material changes will be communicated via your registered email address or prominently through the control panel at least 30 days before the changes take effect. Your continued use of the service after that date constitutes your acceptance of the updated Terms.
